General Terms and Conditions – Jobpackers.com

1. Definitions

1.1 “Platform” means Koweli Real Estate BV’s online platform with trade name Jobpackers.com, on which Employers can post vacancies and Jobseekers can respond via chat or video calls.

1.2 “Employer” means an individual or organization that posts jobs.
1.3 “Job Seeker” means an individual who responds to job postings and uses chat or video calling.
1.4 “User” means both Employer and Job Seeker.
1.5 “Personal Data” means any data that directly or indirectly identifies an individual, including name, e-mail, telephone number, video or audio recordings.

2. Applicability

2.1 These General Terms and Conditions apply to the use of the Platform.
2.2 By registering and using, the User agrees to these terms and conditions and the processing of personal data as described.

3. Account and Access

3.1 Users are responsible for the confidentiality of their account information.
3.2 Unauthorized use of accounts should be reported to the Platform immediately.

4. Use of the Platform

4.1 Chat and video communications may only be used for application and job-related purposes.
4.2 Abuse, harassment, discrimination or inappropriate content is prohibited.
4.3 Employers and Job Seekers are responsible for the secure sharing of sensitive personal data.

5. Personal data and AVG

5.1 The Platform processes personal data in accordance with the Privacy Statement.
5.2 For all communication via chat or video, each User should be aware of the AVG:
– Only necessary data may be shared.
– Recordings of video or audio conversations may only be made with the explicit consent of all parties involved.
– Video recordings will not be kept.
– Chat history will be kept for a maximum of 60 days.
5.3 Users may submit requests to access, correct or delete their data through the Platform.
5.4 The Platform takes appropriate technical and organizational measures to protect personal data from loss, theft or unauthorized access.

6. Liability

6.1 The Platform facilitates contact, but is not a party to employment contracts or agreements.
6.2 The Platform is not liable for the content of job postings, responses or chat/video call communications.
6.3 Users indemnify the Platform for claims arising from the sharing of inaccurate or sensitive personal data.

7. Intellectual Property

7.1 All Platform content and software are the property of Whoppers BV.
7.2 Use of content for commercial purposes without permission is prohibited.

8. Termination and Suspension.

8.1 The Platform may block an account for violation of these terms or AVG guidelines.
8.2 Users may delete their account and associated personal data.

9. Changes

9.1 The Platform may modify these terms and privacy policy.
9.2 Changes will be published; by using after modification, the User agrees to the new terms.

10. Applicable law

10.1 Dutch law shall apply.
10.2 Disputes shall be submitted to the competent court in Breda, the Netherlands.
